1. What kind of data do we collect?

We process your data, which you voluntarily provide or leave us in order to provide you with our services or in connection with the interest in our offer. In particular, we collect and process personal data that will allow us to identify you and your qualifications to dispose of the rented car, such as identifying data (e.g. name, surname, PESEL number, place of residence, nationality, gender, driving license), contact details (e.g. phone number or e-mail) and other information necessary to conclude the contract.

 

2. How do we share your data with third parties?

Your data may be entrusted to companies cooperating with us in the implementation of our services. The largest group of entities we work with are our employees and IT system administrators. They are often self-employed and therefore independent entities in the light of the law. The second group includes service providers of various types of administrative, IT and organizational solutions. We provide them with your data to enable them to provide you with the highest possible level of service. There are other entities that may receive some of your data. These include companies that we use to provide you with ENGO services, such as hosting, network traffic monitoring, and financial institutions. In justified cases, also the relevant authorities. 3. What procedures do we use for the protection and storage of personal data?

In accordance with EU data protection regulations, we follow procedures aimed at preventing unauthorized access to and misuse of personal data.

5. Who is responsible for the processing of personal data?

Whenever we obtain data from such sources, we ensure that the Partner undertakes to apply electronic, organizational and physical protection standards in such a way that they are at least as strict as ours.

 

7. How do we collect and use data?

Data relating to you may be used in the following ways:

7.1 Account Data and profile data: creating an Account requires you to provide personal data. Such data may include, for example, name and surname, e-mail address, telephone number. When logging in to the service via an external authentication service offered by entities over which we have no control, e.g. Facebook Connect, we obtain data only in the form of an e-mail address and only for the purpose of such logging.

7.2 Vehicle rental: we collect your data to be able to provide you with a vehicle rental service. For this purpose, we need to identify you and save relevant data about you and your driving license. According to our regulations, appropriate permissions and age are required to drive individual vehicle classes. Hence, we must verify that you meet these requirements before handing over the vehicle to you.

7.3 Customer Service: As part of our service, we collect and process your data when you contact the User Service department. These data may be necessary for our communication (e.g. answering your questions). Contact will also be possible through the use of data placed for this purpose on the User's Account or via Chat. If permitted under applicable law, we will also collect (and otherwise process, for example, store) other personal communication data, e.g. information about support requests or feedback from you.

7.4 Direct marketing: We offer you our services in a direct way (direct marketing), additionally tailoring them to your needs, using data compilation from various sources and creating a profile (profiling for marketing purposes), (the basis of art. a GDPR).

7.5 Communicating with You: We may contact you on other occasions, including via e-mail, traditional mail or SMS - the selected method will depend on the information you provide. If you use our services, we may send you a questionnaire or ask you to evaluate your experience with ENGO.

7.6 Research and Development: We may use the information we collect to test, research, analyze and develop products. This enables us to improve and enhance the security and protection of our services, develop new features and products, and provide insurance and financial solutions related to our services.

7.7 Market research: We sometimes ask our customers to participate in market research. Any type of personal data used for research will only be used with your consent.

7.8 Monitoring phone calls: when you call our customer service team, ENGO can use the automatic phone number detection system to match your number with the customers in the database, which helps to save time spent on asking for authorization data and improving the quality of service . 7.9 Legal aspects: in certain cases, it may be necessary to use your data to resolve legal disputes, in the case of official proceedings, in matters related to compliance with the law.

8. How do we share your data with third parties?

8.1 Data administration: At ENGO, we use a number of technological solutions to improve data management and car rental. We have our own software, but we also use external services. The recipient of your personal data will be companies cooperating with us in the field of IT services, accounting and archiving services, and marketing services. Thanks to the cooperation with the above-mentioned service providers, we are able to optimize the company's operation and offer you correspondingly lower service prices. However, for this purpose we use the services of third parties to help us achieve these goals.

8.2. Intermediation of communication: ENGO uses the services of external entities to improve communication with you. In particular, we use the services of the application for communication by text messages and data archiving to facilitate the administration of your data.

8.3 Competent authorities: We share personal data with law enforcement authorities to the extent necessary to prevent, detect and prosecute perpetrators of crime and fraud.

8.4 Advertising Partners: ENGO's services are advertised by third party business partners (so that relevant advertising is targeted at the right audience), therefore we may share personal information with advertising partners, including your email address. We only provide encrypted e-mail addresses, so they correspond to current customer databases. We do not share e-mail addresses for any other purpose.

 

9. What security measures do we use to protect personal data?

In accordance with the provisions on the protection of personal data in force in the European Union, we have implemented appropriate procedures aimed at preventing unauthorized access to personal data or their unlawful use.

We use appropriate systems and procedures to protect the personal data entrusted to us by you and ensure its security. We have also implemented security procedures and technical and physical restrictions to prevent access to and use of personal data contained on our servers. Only authorized personnel may access private information solely for the purpose of their job.

 

10. Do we transfer personal data outside the European Union countries?

Our partners are based mainly in Poland and other countries of the European Economic Area (EEA). Some of our service providers are based outside the EEA. In connection with the transfer of your data outside the EEA, we made sure that our suppliers guarantee a high level of personal data protection. These guarantees result in particular from the obligation to use standard contractual clauses adopted by the Commission (EU) or participation in the "Privacy Shield" program established by the Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 on the adequacy of protection provided by the EU-US Privacy Shield.

 

11. How long do we keep your personal data?

We store your personal data for the period necessary to perform the contract or service. In order to pursue our legitimate interest, your personal data will be stored until you submit an objection, subject to the period in which your data will be necessary for processing in order to establish, assert or defend claims. Your personal data that we process for direct marketing purposes will be stored for a maximum of 5 years or only until you withdraw your consent or object to us, then we will stop processing your data for this purpose.

 

12. Can you delete your personal data?

ENGO, as the administrator of your data, is obliged to delete your data when you ask, if:

• Your data (or part of it) is not necessary for the administrator to achieve the purpose for which it was collected or otherwise processed
• You will withdraw your consent to the processing of your data (if you have given your consent, you always have the right to withdraw it)
• You raise an objection, justified by your special situation, to the processing of your data by the administrator for the performance of a task carried out in the public interest or in the exercise of public authority or necessary for the purposes of the legitimate interests pursued by the administrator
• Your data has been processed unlawfully (e.g. there is no legal basis for processing or is used for another purpose)
• The obligation to delete data results from applicable law
• The personal data was collected in relation to offering information society services to a child

If one of the above conditions is met, ENGO is obliged to delete the data.

 

13. When can we refuse to delete your personal data?

Remember that the data administrator will not always meet your request. The period of processing many categories of data is often determined by law (employee data, data processed for tax purposes, etc.). The administrator will refuse to delete your personal data if they are necessary for:

• to exercise the right to freedom of expression and information
• for archiving purposes in the public interest, for scientific or historical research purposes or for statistical purposes, insofar as it is likely that the exercise of the right to erasure will prevent or seriously hamper the achievement of the purposes of the processing
• to establish, assert or defend claims

 

14. How to submit a request for deletion of personal data?

The request for the deletion of personal data should be submitted in electronic form to the address privacy@engocars.com with the title: "Request for the deletion of personal data".

 

15. How long do we have to process your request for deletion of personal data?

ENGO will try to consider your application immediately. However, we reserve a month as the maximum time to fulfill your request. Within one month of submitting your application, you should receive information about deletion or refusal to delete. In a special case, if the request is of a complex nature or ENGO has received a large number of requests, it may inform about the extension of the deadline for completion to a maximum of two months.

 

16. Do we use cookies and similar technologies?

ENGO uses cookies and other identification technologies on its websites in its applications, websites, e-mail messages and online advertising for the purposes described in this policy. 18. Do we use Google services for marketing, remarketing and promotion?
